Assistant Manager - Legal Collections

Key Responsibilities

• Case Strategy & Management: Develop and implement effective recovery and litigation strategies for NPA accounts. Oversee end-to-end management of legal cases in various forums including DRT, DRAT, arbitration tribunals, and civil courts.
• Legal Documentation & Compliance: Review, draft, and finalize legal documents, pleadings, affidavits, and recovery applications (OAs) to ensure accuracy and strategic alignment with legal requirements. Ensure all recovery actions are compliant with regulatory guidelines (RBI, internal policies, etc.).
• 
  Coordination with Legal Counsel: Liaise with external advocates, legal counsels, and recovery agents to ensure timely filing of cases, effective representation, and execution of recovery orders/certificates.
• SARFAESI Act Enforcement: Initiate and manage actions under the SARFAESI Act, including issuing demand notices (Section 13(2)), taking possession of secured assets, and overseeing their auction/sale to recover dues. Handle any appeals (Securitisation Appeals) filed by borrowers with the DRT against the company's actions.
• DRT & Arbitration Proceedings: Manage all aspects of proceedings within the DRT/DRAT framework and arbitration processes. This includes preparing detailed case narratives, ensuring timely submission of evidence, attending hearings, and following up on recovery certificates issued by the Presiding Officers.

  Engage with defaulting borrowers and guarantors to negotiate viable repayment plans, settlements, or asset redemption, aiming for timely resolution and minimizing further legal delays.
• Monitoring & Reporting: Track the progress and disposal rate of all assigned cases, providing regular, detailed reports and briefings to senior management on recovery performance and potential risks.
• Risk Mitigation: Identify legal and operational risks in the recovery process and recommend mitigation strategies to safeguard the company's interests and ensure business continuity.
• Team Management: Lead and mentor a team of recovery officers and specialists, fostering a culture of high performance and ethical conduct in line with fair debt collection practices.
