Position Summary
As the Brand Compliance Manager, you will be responsible for ensuring the integrity and protection of our brand identity across various channels. Your focus will be on monitoring and addressing trademark infringement, unauthorized sellers, minimum advertised price (MAP) enforcement, and maintaining brand compliance with partner resellers. You will work closely with Marketing, Finance, and Program Management and play a crucial role in upholding the reputation and value of our brand while mitigating risks associated with unauthorized activities.
Key Responsibilities:
  • Trademark Infringement Monitoring and Enforcement:
    • Regularly monitor online channels and Google Alerts for any unauthorized use of our trademarks, documenting each infringement.
    • Take appropriate actions to address instances of trademark infringement, including issuing cease and desist notices, preparing documentation for legal action when necessary, and following up on past-due violations by email and phone.
    • Be the point of contact within the company for trademark infringements found by others within the company.
    • Proactively identify scam sites that pose a threat to our brand reputation and work with third-party brand partners for delisting from search results.
    • Monitor the Smart Brand portal with links to mentions of our brand across the Internet, social media, and global marketplaces to identify webpages that include trademark infringement, counterfeit products, and unauthorized sellers. Identify each infringement for third-party partners to enforce.
  • Unauthorized Sellers Management:
    • Identify unauthorized sellers across e-commerce platforms and other channels and take action to remove the unauthorized listing of POLYWOOD through cease and desist letters and with third-party brand partners.
    • Implement measures to prevent unauthorized sales, including collaborating with sales management to determine the appropriate resolution for each case and enforcing seller agreements.
    • Monitor third-party portal to identify unauthorized sellers on Amazon and work with third-party to remove these listings.
  • MAP Monitoring and Enforcement:
    • Monitor and enforce MAP on authorized sellers websites and marketplace listings through third-party portal, documenting all violations.
    • Take appropriate actions to enforce MAP policies and address violations effectively by working with the sales team to make corrections within an acceptable timeframe and issuing enforcement letters when necessary.
  • Brand Compliance with Partner Resellers:
    • Monitor partner resellers to ensure adherence to brand guidelines and policies are being met.

      Provide documentation of brand infringements to the sales team to enforce brand standards across all resellers to maintain consistent brand representation and customer experience. Issue enforcement letters when necessary.
  • Reporting:
    • Provide accurate reporting weekly to the CFO of the status of all infringements, MAP violations, and key trends.
    • Provide monthly overview report for senior management.
    • Provide year-end reporting.
Requirements
  • Excellent analytical skills with the ability to interpret data and identify trends.
  • Effective communication with the ability to interact with internal teams, external partners, and legal entities.
  • Ability to work independently, prioritize tasks, and manage multiple projects simultaneously.
  • Familiarity with regulatory requirements and industry standards related to brand compliance and protection.
  • Familiarity with the software used for this role including Smart Protection and Smart Brand, Salsify, Podio, Acumatica, ShareX, and Zendesk preferred but not required.
  • 2-5 years in a compliance role.
