Job Description
Position: State Head Legal (Non-Litigation)
Experience Required: Minimum 5 years of relevant experience in Mortgage Business
Department: Legal
Reporting To: Head – Business Legal
Key Responsibilities:
1. Legal & Business Experience
- Strong experience in Business Legal matters with a focus on property and mortgage transactions.
- Vetting and verification of original property documents to ensure clear and marketable title.
- Preparation and review of Title Search Reports (TSR) and related legal due diligence.
2. Legal Knowledge & Compliance
- Well-versed with relevant laws including:
- Transfer of Property Act
- Registration Act
- Indian Contract Act
- Other applicable local building laws, mortgage, and property-related regulations.
- Ensure compliance with State-specific property laws and government regulations.
3. Vendor (Lawyer) Management
- Empanelment, coordination, and performance management of external lawyers and legal firms.
- Liaison with external counsel for drafting, vetting, and execution of legal documents.
4. Transaction & Documentation Handling
- Oversight of Re-sale transactions, Mortgage Deed Execution, Equitable Mortgage, and Drafting/Vetting of Legal Documents.
- Ensure timely presentation before Sub-Registrar Offices and completion of registration and mortgage formalities with relevant authorities.
5. Team & Field Operations
- Lead and manage the legal team at the state level to ensure efficiency and accuracy in legal operations.
- Conduct site/property visits for high-value or sensitive cases to assess:
- Property usage and construction stage
- Nature of land (Agricultural / Residential / Industrial / Mixed Use)
- Habitation and neighbourhood conditions
- Verification and identification of property boundaries and ownership
6. Mortgage Business Acumen
- Demonstrated understanding of mortgage lending processes, property risk evaluation, and security creation.
- Provide strategic legal insights to support business growth and risk mitigation in mortgage operations.
7. Work Flexibility & Professional Conduct
- Display flexibility to work extended hours or beyond regular office timings when business requirements demand.
- Be willing to travel within the state for property verification or registration-related work.
- Maintain a high level of professional integrity, confidentiality, and attention to detail in all tasks.
Qualifications & Skills:
- LLB / LLM from a recognized university.
- Minimum 5+ years of relevant experience in mortgage, property, or real estate legal functions.
- Excellent knowledge of State-specific property laws and real estate documentation.
- Strong analytical, drafting, and negotiation skills.
- Ability to manage multiple stakeholders including business teams, external lawyers, and government authorities.
- Travell within the state for property/legal due diligence.
- Ability to adapt to dynamic work environments and meet tight deadlines when necessary.
